Practice Areas

I work mainly in civil law, in the fields set out below. In each of them my assistance covers both advice given in advance and representation in court.

Civil law

I act for individuals and businesses in civil disputes generally: obligations and contracts, contractual and non-contractual liability, compensation for damage arising from road traffic accidents and from medical malpractice, rights in property and relations between neighbours, and consumer protection in dealings with professionals and businesses.

The work covers the out-of-court stage – formal demands, negotiations, mediation and assisted negotiation – and proceedings before the Justice of the Peace, the Court of First Instance, the Court of Appeal and the Court of Cassation.

Family law

I act for spouses and cohabiting partners in separation and divorce, whether by consent or contested, and in applications to vary conditions already established: custody of children, residence and contact arrangements, maintenance for children and for a spouse, allocation of the family home, and division of jointly owned assets.

I also handle the solutions that avoid proceedings – assisted negotiation and agreement before the registrar of civil status – and cases concerning parentage, recognition and parental responsibility. I am a member of the “Parentage, Fostering, Adoption and Related Legislation” Committee of the Rome Bar Association.

Leases

Assistance to landlords and tenants in every question arising from residential and commercial tenancy agreements: drafting and review of the agreement, registration and tax formalities, unpaid rent, eviction for arrears and on expiry of the term, repossession of the premises, return of the deposit, allocation of expenses, withdrawal and notice to quit.

I follow the whole procedure, from the notice to quit through to enforcement of possession, and deal with the enforcement officer and with the other parties involved.

Condominium law

Advice and assistance to condominiums, managing agents and individual unit owners: challenges to resolutions of the owners’ meeting, allocation of expenses, recovery of unpaid contributions, water penetration and damage from common parts, improvements and extraordinary works, disputes with the managing agent, condominium regulations and the schedule of shares.

I also act for the condominium itself as a party, in proceedings brought by third parties or by individual owners, and in applications for the preliminary taking of expert evidence.

Debt recovery

Assistance to individuals, professionals and businesses in recovering unpaid debts: formal demand and notice of default, application for an order for payment, opposition to an order for payment, attachment of goods, of land and of debts owed by third parties, registration of a judicial charge, and insolvency proceedings.

Before any action is started I consider with the client the strength of the claim, the debtor’s solvency and the relationship between cost and the real prospects of recovery, so that the choice of remedy is a considered one.

Contract advice

Drafting, review and negotiation of contracts for individuals, professionals and small businesses: leases and loans for use, sale, works and services contracts, supply and collaboration agreements, settlement agreements, penalty clauses and guarantees.

For contracts concluded with consumers I check that the terms comply with the Italian Consumer Code, beginning with the prohibition of unfair terms. Advice taken in good time defines the parties’ rights and obligations from the outset and reduces the risk of litigation.

Data protection and digital law

I assist professionals, businesses and public bodies with data protection compliance: privacy notices and lawful bases for processing, records of processing activities, appointment of processors, impact assessments, and the handling and notification of personal data breaches.

I also handle the exercise of data subjects’ rights – access, rectification, erasure, restriction and objection – and complaints to the Italian Data Protection Authority.

Tax litigation and tax enforcement

Assistance in challenging notices of assessment, demands for payment and final notices, with appeals to the tax courts at first and second instance, applications for a stay, settlement by agreement with the tax authority and statutory settlement schemes.

At the enforcement stage I handle oppositions to administrative charges on vehicles, to tax liens and to the attachment of debts owed by third parties, applications to pay by instalments and applications for cancellation of the debt.

Estates and succession

I act for heirs, legatees and those called to an inheritance in questions of succession: acceptance with the benefit of inventory and renunciation, ascertaining the extent of the estate, division of assets among co-heirs, the action to reduce dispositions that infringe the reserved share, challenges to a will and the claim to an inheritance.

I also handle the out-of-court stage, from division agreements to the settlement of relations among co-heirs, so as to avoid proceedings wherever the matter can be resolved by agreement.

Defamation in the press

I act for those whose reputation has been injured through the press, television, online publications and social networks. In civil terms the remedies run from the request for a correction under article 8 of Italian Law no. 47 of 8 February 1948, through formal demands for the removal or delisting of content, to the action for compensation for pecuniary and non-pecuniary damage.

Before proceedings are begun I consider with the client whether the claim is well founded in the light of the limits of the right to report and to comment: where the facts are true, the report is of public interest and the language is measured, publication is lawful and an action has no prospects. For compensation for defamation through the press or another means of publicity, an attempt at mediation is a precondition of proceedings.

The areas listed above are those in which I mainly work. For other questions I either take the matter on or refer the client to trusted colleagues with the necessary expertise.
